Compliance Checklist for Letting Agents in 2026

Compliance for letting agents in 2026 covers both the obligations you have to your landlord and tenant clients, and the regulatory requirements you must meet as a business. This checklist covers both.

Renters' Rights Act documentation

From 31 May 2026, agents must provide every new tenant with the government's official Renters' Rights Act Information Sheet and must ensure all landlords on their books are aware of the new Act requirements. Agents should update their tenancy pack templates, landlord onboarding documentation, and internal procedures before the deadline.

Client Money Protection (CMP)

All letting agents in England who hold client money (rent, deposits, or other funds on behalf of landlords or tenants) must be members of a government-approved Client Money Protection scheme. This has been a legal requirement since 2019. Agents must display their CMP certificate prominently in their offices and on their website. Failure to hold CMP membership is a criminal offence with fines of up to £30,000.

Redress scheme membership

All letting agents in England must be members of a government-approved redress scheme — either The Property Ombudsman (TPO) or the Property Redress Scheme (PRS). Membership must be displayed on the agent's website and in their offices. Agents who are not members of a redress scheme face fines of up to £5,000.

Transparency of fees

Under the Tenant Fees Act 2019, agents must publish a full schedule of their fees on their website and in their offices. Prohibited fees (such as referencing fees charged to tenants) must not be charged. Agents should review their fee schedule annually to ensure it remains compliant.

Data protection

Letting agents who process personal data (which includes virtually all agents) must be registered with the Information Commissioner's Office (ICO) and must have a privacy policy that complies with UK GDPR. Agents should review their data retention policies, consent processes, and subject access request procedures annually.
